Terms & Conditions

The following are terms of a legal agreement between you and Nerdcore Computers Service Centre and its accociated companies. By accessing, browsing and/or using anything on this site and the server it’s hosted on, you acknowledge that you have read, understood, and agree to be bound by the terms below and to comply with all applicable laws and regulations. If you do not agree with these terms, don’t use this site or our services.

1. Authorization

The client authorizes Nerdcore Computers Service Centre to conduct an evaluation of the machine sent to determine the nature of the damage and provide an quotation of repair cost and timing. The evaluation is free and no work beyond this evaluation will be charged without explicit client approval.

The client authorizes Nerdcore Computers Service Centre, its employees, and agents, to receive and transport this media/equipment/data to, from and between their facilities.

2. Legal Rights

The client is the legal owner or authorized representative of the legal owner of the property and all data and components contained therein sent to Nerdcore Computers Service Centre.

Any property left with Nerdcore Computers Service Centre unclaimed for 30 days, will be disposed. At which time, Nerdcore Computers Service Centre shall have no liability to the client or any third party. This will be mentioned to you.

3. Limited Liability

Nerdcore Computers Service Centre shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service.

In no event will Nerdcore Computers Service Centre be liable for any damage to the laptop/desktop, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if Nerdcore Computers Service Centre has been advised of the possibility of damages or loss to persons or property. Nerdcore Computers Service Centre liability of any kind with respect to the services, including any negligence on its part, shall be limited to the contract price for the services.

4. Confidentiality

Nerdcore Computers Service Centre agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client’s equipment except to employees or agents of Nerdcore Computers Service Centre subject to confidentiality agreements or as required by law. None of your personal information is stored at our office ie. name address credit card details problem description of fault and any history we have of you and your business. Your information is stored only for the soul purpose of our business to be accessed an given to our technician to contact you an liase with you.

5. Payment

Payment is due in full upon completion of successful repair, even after the warranty period if the repair is completed and you have not understood our terms of trade you still will not be given your money back prior to release of the repaired machine (whether shipped, or picked up), unless by special previous arrangement.

The client is financially responsible for all shipping costs, custom duties and taxes to and from Nerdcore Computers Service Centre.

6. Warranty

30 days warranty on laptops/desktops that Nerdcore Computers Service Centre has repaired, Nerdcore Computers Service Centre makes no warranty on data, express or implied, and Nerdcore Computers Service Centre disclaims any data warranty of any kind. If you agree to to this then you also understand that if your computer breaks before or after even during the time that we are repairing we will not be liable in shape or form unless its our fault. Our team has to inspect your computer after the return or after the 30 days warranty to ensure that your network is not suffering from any serious virus attacks. Which in most cases removing it from your laptops computers desktops does not guarantee that it is removed from your modem or networking environment.

7. Agreement

The parties shall submit all disputes relating to this Agreement (whether contract, tort or both) to arbitration, in accordance with the Rules of the Australian Arbitration Association/China business rules. Either party may enforce the award of the arbitrator in a Court of competent jurisdiction. The parties understand that they are waiving their rights to a jury trial. The arbitration shall take place in the Country in which the Nerdcore Computers Service Centre laboratory performing the services is located and the laws of the State/County in which such laboratory is located shall apply.

We have these governed terms of trade in place to protect the technician and you from any mis concluded information you might believe your rights hold. If for any reason there is any complications were both you and the technician cannot come to an agreement a third body will police the protection of any items that are not paid in full will be held in custody by Nerdcore computers service centre. There if you choose to appoint a solicitor to deal directly with us please do so.

No fix, no fee policy

Our no, fix no fee policy means that if the engineer does not possess the necessary technical knowledge or ability to resolve the problem or effect the repair, then no charge is made to the customer, apart from a small diagnoses fee of $45.

If the engineer is able to resolve the problem or effect the repair, but is only prevented from doing so by the customer requesting the engineer not to proceed with the work, then the customer is charged for the engineer’s time spent to that point – i.e. a minimum of 2 hours.

If the engineer is able to resolve the problem or effect the repair, but is only prevented from doing so because the customer does not possess the required (spare) parts, software CD-Rom or Product Key, then the customer is charged for the engineer’s time spent to that point – i.e. a minimum of 2 hours.

If the engineer provides a clear and precise diagnosis of a failed component and the customer decides not to proceed with the replacement of the component, then the customer is charged for the engineer’s time spent to that point – i.e. a minimum of 2 hours.

The policy does not apply to work related to data recovery, computer virus or spyware problems or to cases in which the computer has been struck by lightning or natural god disaster activities or such.

Any software that was preloaded ie. tool bars extension in web browsers additional software that is not provided to the technician is not responsible to ask the customer or reinstall these software. 

Software You the client must provide all software required to restore your computer ie. Operating System Disks including Product Codes for re activation of your software on your computer including Microsoft Office product keys. Before you ask of any work from the technician if you cannot provide the software then it will not be reinstalled if you dont have the required disks or software your technician will offer you a current operating system installation for example windows 7 including packaging an product key.

No pirated software can be preloaded onto the computer by anyone from Nerdcore Australia. Any software that is not recommended by the technician for reinstallation for example third party tool bar in browsers ie. internet explorer, microsoft edge, google chrome, mozilla firefox, opera, safari will not be reinstalled due to malware being redirected after installing these non functional toolbars.  If you previously had third party tool bars for your application an you choose to reinstall these toolbars we cannot cover the 30 day warranty offered by Nerdcore Australia. You have up to 30 days to bring to our concern any problems that your computer might be having after service. Its normal that after a complete reformat that the operating system requires many downloads to stay upto date. Which we cannot update a operating with all the updates in 24 hours as they are downloaded automatically from Microsoft an normally takes up to 2 months for these updates to automatically synchronize with your OS. If you want the technician to inspect the tool bar or any software that you suspect started the problem to begin  with you can do so at either the start of the work or in the 30 days warranty period. This will also involve the technician to check to see if your system may contain illegal malware before they even begin working on your computer an record this information for any misunderstanding you might have about what started the problem. Were here to help and go the extra mile to help our customers with any problems.

If you choose not to come back within the 30 days warranty then we cannot help you beyond this point. If you feel that your treated unfair ring us on 1300Nerdcore to speak to one of team were they can help best.
